CRIMINAL LIABILITY OF LEGAL ENTITIES (Legislative Decree 231/2001)

With Legislative Decree 231/2001, the principle 'societas delinquere non potest' fell. If a (natural) person commits an offence in the interest of the Entity of which he or she is a member, the latter can also be held liable if it has not adopted all the instruments to prevent the commission of offences.

The firm offers legal assistance to companies, associations and organisations on the subject of Legislative Decree 231/2001, both in the preventive phase (adoption of safety measures to prevent the commission of offences and establishment of the supervisory body) and in the judicial phase to ascertain liability for offences committed by apical individuals or their subordinates.
