CRIMINAL LIABILITY OF LEGAL ENTITIES (Legislative Decree 231/2001)

Legislative Decree 231/2001 abolished the principle of “societas delinquere non potest” (a corporation cannot commit a crime).

If a person (natural person) commits a crime in the interests of the entity to which they belong, the latter may also be held liable if it has not adopted all the measures necessary to prevent the commission of illegal acts.
